Learning outcomes :
The exercises sessions are an extension of the Law of obligations course and pursue a twofold goal.

The first is to train the student in applying the law to the facts and to allow him/her to approach the subject matter in a concrete way by being introduced to the sources and acts (reading decisions rendered, analysis of documents of practice, etc.), as well as to help him/her to seek the solution of a legal problem by having to solve a practical case. Emphasis will be placed on learning and mastering concepts and the ability to apply them to the facts.

The second is to train the student to understand the legal concepts. The sessions and the writing of a written report will aim to improve the ability to develop a coherent and convincing argument and to present it in a precise and structured way.

Course contents :
The sessions are devoted to the resolution of exercises and the analysis of documents.

The sessions allow the student to develop a practical approach to the lecture content. Each session focuses on a specific topic, namely: the sources of obligations and the formation of contracts (session 1), sanctions for non-execution and contractual clauses (session 2), the transfer of obligations (session 3) and the proof of obligations (session 4).


Planned learning activities and teaching methods :
The exercises sessions take the form of four compulsory two-hour sessions organised in the first quarter of the academic year.

In addition to the sessions devoted to the apprehension of the legal concepts through practical cases and documents analysis, each student has to solve a case by writing a written report.

Assessment methods and criteria :
As part of the exercises sessions, the student have hand in a written report of 7 to 10 pages, that will evaluate the quality of the intellectual approach, the rigour both in substance and form, the accurate use of sources and the compliance with constraints.

Halfway, and on the communicated date, the student are invited to hand in his or her status of the issue to the assistant, including a plan reflecting the status of the issue, a summary and a provisional bibliography. All the specific modalities and requirements about the written report and the state of the issue are contained in the requirements specifications in the beginning of the course syllabus.

Both the written work and the status of the issue have to be sent by email to the assistant, as well as posted on the ephorus server, on time communicated by the assistant.

The exercises sessions grade awarded will be expressed on 20 points. The written report will constitute 15 points out of 20. The remaining 5 points will be devoted to assess the active participation in the sessions and the status of the issue.

The exercises sessions form, with the lecture course with which it is associated, a single teaching unit, sanctioned by an indivisible number of credits. The final grade expressed on 20 points, given to the student for this course will be based on the examination grade (75% of the final grade) and the exercises sessions grade (25 % of the final grade).

The student's attention is bring to the existence of "sanctions" that will automatically apply in the following situations:
•0,5 points will be withdrawn for each day of delay in the delivery of the status of the issue. A delay exceeding 10 calendar days will be irrefragably assimilated to a lack of delivery, resulting in the sanction "OA".
•2 points will be withdrawn for each day of delay in the delivery of the written work. A delay exceeding 5 calendar days will be irrefragably assimilated to a lack of delivery, resulting in the sanction "OA".
•0,5 points will be withdrawn by spelling error.

The exercises sessions grade is 0A/20 in case of an unjustified absence from more than one session or an unjustified failure to submit any "genuine" written work. This 0A/20 automatically extends to the overall marks assigned to the Teaching Unit for the session concerned. If the concerned student nevertheless decides to take the examination relating to the lecture course of the Teaching Unit in question, and if the marks awarded to his or her examination is equal to or greater than 10/20, it will be kept for a subsequent session of the same academic year.

The general regulation for studies and exams, the code of ethics regulating the writing of scientific works, the specific regulations of the Faculty of Law, as well as the common specifications for exercises sessions with casus are strictly applicable, except for specific exceptions contained in the requirements specifications in the beginning of the syllabus.
