Learning outcomes :
The protection of monuments and sites falls under a special policy that has resulted in abundant case law that regularly leads to actions both from the legislators who develop new facets of the special policies and from the judicial bodies responsible for settling disputes that fall under other types of special policies.

Moreover, roadway legislation and legislation regarding abandoned commercial and industrial sites are often implemented when a real estate investment project is being considered for approval.

The objectives consist of understanding the various instruments of protecting monuments and sites and the procedures to be implemented with regard to roadways and abandoned commercial and industrial sites so as to enable the realisation of real estate investment projects.

Course contents :
Protection of monuments and sites.
The course initially tackles the question of the protection of monuments and sites from the international perspective as well as that of the distribution of competences. Afterwards, it covers in-depth the applicable legislation in the French-speaking part of the Walloon Region. Finally, it turns its attention to the existing differences in the laws pertaining to the Brussels Region.

The roadway system
With regard to the roadway system, the course examines general questions such as the distribution of competences, definitions, the creation of public roadways, classification and roadway administration, both its management and the policies affecting it. Afterwards, the course covers the specific aspects of each of the applicable bodies of legislation (common law (major roadways),
the motorway system,
the unnamed municipal roadway system,
the local roadway system).

Abandoned commercial and industrial sites.
With regard to abandoned commercial and industrial sites, the course compares the applicable legislation in the Walloon Region and in the Brussels-Capital Region.

Analysis of case law and case studies.
