Course contents :
The course relates to the procedures for awarding public contracts (primarily in the sectors known as "traditional").
Initially, the European and Belgian sources of regulations (currently being revised) are detailed.
Next, the material scope of application (definition of public contracts for work, supplies and services) and the personal scope of application (concept of contracting authority) are studied.
Finally, the successive stages of the procedure of awarding a public contract are reviewed: choice of the means of awarding, drafting and approving the special terms of reference, prior announcement, submission of the bids, examination of the bids (regularity, qualitative selection and choice of the tenderer), drafting of the reasoned decision, details on the tenderer and the unsuccessful tenderers and the conclusion of the contract.
Characteristics of the disputes resulting from public contracts are lastly (briefly) covered.

Planned learning activities and teaching methods :
Lectures.
In light of the limited number of class hours and the wide range of experience of the Master's students, the theoretical framework is covered in broad strokes and illustrated by "particular questions", drawn from experience, and which are examined more in detail.
Within the limit of the time available, the students are encouraged to share their professional experience in relation with the "particular questions" covered during the course.

Assessment methods and criteria :
Written examination, including theoretical questions (ex. definition of concepts covered during the course) and practical questions (ex. drafting of a reasoned decision for awarding a public contract).


Recommended or required reading :
To take part in the course, the students must imperatively be in possession of the main regulations in application namely:
- La directive du 31 mars 2004 n°2004/18/CE du Parlement européen et du Conseil relative à la coordination des procédures de passation des marchés publics de travaux, de fournitures [et la directive du 31 mars 2004 n° 2004/17/CE du Parlement européen et du Conseil relative à la coordination des procédures de passation des marchés dans les secteurs de l'eau, de l'énergie, des transports et des services postaux]  ;
- La loi du 24 décembre 1994 relative aux marchés publics et à certains marchés de travaux, de fournitures et de services (à ce jour encore en vigueur)  ;
- La loi du 15 juin 2006 relative aux marchés publics et à certains marchés de travaux, de fournitures et de services (à ce jour très partiellement en vigueur)  ;
- L'arrêté royal du 8 janvier 1996 relatif aux marchés publics de travaux, de fournitures et de services et aux concessions de travaux publics  [et l'arrêté royal du 10 janvier 1996 relatif aux marchés publics de travaux, de fournitures et de services dans les secteurs de l'eau, de l'énergie, des transports et des services postaux]  ;
- L'arrêté royal du 15 juillet 2011 relatif à la passation des marchés publics dans les secteurs classiques (à ce jour très partiellement en vigueur)  ;
- L'arrêté royal du 26 septembre 1996 établissant les règles générales d'exécution des marchés publics et des concessions de travaux publics (et son annexe  : le Cahier général des charges).

For the examination, students are advised to read some rulings of principle (of which the references will be given during the lecture).

To further the knowledge of the subject, one will be able to refer to the works and reviews whose references will be given in the appendix to the course outline.
