COMU2103 - Law and deontology of interactive and collaborative communication

Skill 1 - The ability to manage an organisation's presence in digital media
Learning Outcomes (students will be able to):
1. Perform prospective analysis of an organisation's digital communication activities, taking into account the market in which it operates, as well as social, cultural, technological, commercial, political and legal contexts.
3. Design and implement digital communication tools and activities - harnessing an organisation's human, financial, material and legal resources, and taking constraints into account.
6. Ensure that the organisation's digital communication practices comply with the law, as well as with deontological and ethical norms.

Skill 4 - As a basis for personal critical reflection or use in research projects - use appropriate methods to gather, marshal and generate useful knowledge in the field of digital communication.
Learning Outcomes (students will be able to):
2. Draw on knowledge from different disciplines to develop and defend personal critical reflection on the human and social implications of digital technologies, including relating to legal, deontological and ethical questions.

Course contents :
So-called "virtual" universes are no lawless zones and are governed by increasingly numerous and complex legal and ethical rules.

The course will address them through the following main topics:
- freedom of speech on social media and its limits (press offences, image rights, e-reputation, protection of personal data, etc.);
- the protection of intellectual property (copyright, trademarks, databases, domain names, etc.);
- online e-commerce and consumer protection (distance contracts, online advertising, liability of intermediaries, etc.);
- the regulation of audiovisual online content;
- deontology applicable to professional use of the web (PR codes of conduct and journalistic and advertising self-regulation).


Planned learning activities and teaching methods :
The various topics will be addressed from case studies on the basis of which the applicable legal and/or deontological principles will be identified.

A collective discussion will then be stimulated on how to interpret and apply these principles in different factual situations. Links are frequently made between the different subjects covered, as well as with current events, so that students learn to develop a critical interpretation and argumentation of the legal and ethical issues submitted to them.

In order to make the course as interactive as possible and to help them prepare for the next course, students will be invited each week to read and analyze one or two case law decisions, opinions issued by self-regulatory bodies or contractual documents, or to work on practical cases. This work will not be evaluated. They will also have the opportunity to submit practical cases or topical issues for collective discussion.

Theoretical aspects will be exposed ex cathedra by the lecturer, alternating with brainstorming and analysis group sessions.

Covid-19 special measures

If the evolution of the health situation so requires, the course could be delivered remotely, in whole or in part, via the online learning platform or any other tool made available by the University.


Assessment methods and criteria :
Written and individual examination consisting of case studies to be analyzed in the form of open-ended questions.

Students will be assessed on their ability to isolate and understand the legal and/or ethical issues raised, as well as on their ability to think and argue when applying their theoretical knowledge to the case studies submitted to them.

Passing the exam requires a mark of 10/20 or higher (sum of the marks obtained for the different questions).

The second session examination will be held in the same form and assessed according to the same evaluation criteria as the first session examination.

Covid-19 special measures

If the evolution of the health situation so requires, the written examination could be organized remotely, via the online learning platform or any other tool made available by the University, according to the same evaluation criteria.
