DROI1232 - Law theory seminar: political science programme

Learning outcomes : At the end of the seminar, the students should:
o be aware of fundamental issues and reflect critically on law and philosophy of law;
o have acquired the capability to understand texts on theory of law, to synthesise them and critique them in a discussion in group;
o have studied thoroughly, in a critical perspective, through personal research, and by using aspects of positive law and theory of law, an issue relating to social law in the broadest sense;
o have been able to write a text of about 20 pages on this topic, basing themselves on personal research and on an extended bibliography, providing a critical analysis of the studied question;
o have been able to develop in class their work in an oral presentation of 15 - 20 minutes.
Prerequisites : The students should have followed the course ìIntroduction to contemporary juridical thinkingî given during the first semester.
Course contents : The content of the seminar, whose themes change each year, is structured around the following approaches:
- first of all, we will read and discuss texts on different topics of theory of law relating to legislative review (reasons of the review? author(s) of the review? nomenclature ? etc.). Then, the reading will be on more specific themes related to social law in the broadest sense (housing, integration income, etc.). These topics will constitute the material for the business legislative review;
- After the introductory sessions, the students are invited to make further research on one of the specific topics that are proposed. For their work, they have to make an attempt of legislative review on a chosen topic related to positive law. At the end of the second semester in third year, each student is invited to hand out this work of about twenty typed pages. Beforehand, the students will be asked to provide the professor with an outline of their work to discuss it. During the second semester of the third year, the students will have to develop their work in an oral presentation of about twenty minutes.
Mode of delivery : The texts that the students have to read during the first semester will be available at the repro. For the research on the chosen theme, the professor will provide bibliographical details. Active attendance at every weekly session is compulsory as well as the handing out of an outline of the work and the attendance at the presentations. The professor will be available for the students who want to during his duty hours or on appointment.
Assessment methods and criteria : The assessment is based on the quality of the written work for 80 %. It will take into account criteria that have been defined in the beginning of the seminar (outline, understanding of the subject, coherence, critical mind, written expression, analytical mind, methodology and research). It is based on the students' participation in class and on their oral presentation for 20 %. The correction of the written work will be explained in writing and the students will be invited to take cognizance of it.
Recommended or required reading : The bibliography will be provided with the reading file.
