Learning outcomes :
The first purpose of the course is to make the student familiar with the system of intellectual property (copyright, trade marks, patents) and trade secrets. The student will learn about the ratio, the properties and the structure of the intellectual property rights (protected subject-matter, holders, exclusive rights, exceptions, term of protection, transfer of rights and licences,…). They will learn how to use legal sources at different levels (statutes and case law at the Belgian, European and international level).

Course contents :
- Part 1 : introduction (origin, properties, types, international, European and Belgian sources, structure)
- Part 2 : copyright and neighbouring rights (rights of performers, producers, publishers), software and database rights
- Part 3: trade mark law
- Part 4: patent law
- Part 5: trade secrets
Per type of intellectual property right, we will examine (i) the protected subject-matter, (ii) the owner and transfer of rights, (iii) the scope of protection (exclusive rights, exceptions), (iv) the term and loss of rights. We will examine sources (statutes, case law) at the Belgian, European and international level.
