Learning outcomes :

At the end of the course students will be familiar with such theoretical concepts as right in rem, the concept of property, and possession. What is more, they will juggle easily with the various rights in rem of possession whilst being able to compare them, if necessary. Finally, they will be able to dissect the whys and wherefores of a court ruling and to connect the main lessons thereof with the appropriate provisions of the lecture material.

Course contents :

The course revolves around two main foci, namely, the study of property (with the distinction between movable and real property, for example), and examination of rights in rem or real rights. This second part is in turn divided into two sections: the theoretical definition of the right in rem and the study of the main real rights of enjoyment of property, i.e., ownership (and the way it is acquired by possession) and co-ownership. Special attention will be paid, in this regard, to real rights to things owned by others, i.e., usufruct, use, easements, and so on.



Planned learning activities and teaching methods :
Lecture course fleshed out with seminars and assessed by a written exam. The lecture course will be enriched with recent examples taken from legal practice and European jurisprudence.

First quarter: 30 hours of theory plus three 90-minute seminars sans casus (groups of 20 students). The seminars are waived for students on staggered schedules and students from KUL Brussels.




Assessment methods and criteria :

Written exam. Students will be graded on their mastery of the lecture material and their understanding of the case-law examples studied during the seminars.
